1. Booking Agreement By booking through South Dorset Music (“the Agency”), the client (“the Booker”) agrees to be bound by these Terms & Conditions. A confirmed booking constitutes a contract between the Booker and the Artist, with South Dorset Music acting as an intermediary.
2. Deposit & Payment • A non-refundable deposit (typically 25% of the total fee unless otherwise agreed) is required to secure any booking. • The remaining balance is due no later than 7 days before the event, unless agreed otherwise in writing. • Late payments may incur additional fees or risk cancellation of the booking.
3. Cancellation Policy • If the Booker cancels: • More than 60 days before the event: Deposit retained. • 30–59 days before the event: 50% of the total fee is payable. • Less than 30 days before the event: 100% of the total fee is payable. • If the Artist cancels, the Agency will: • Make every effort to find a suitable replacement. • Refund the Booker in full if no alternative is available. • The Agency is not liable for additional costs beyond the booking fee.
4. Changes to the Booking • All changes must be confirmed in writing. • Changes to performance time, location, or setup may incur additional charges or affect artist availability.
5. Performance Requirements • The Booker agrees to provide a safe, weather-appropriate performance area (indoors or properly covered). • Adequate power supply, parking access, and a private space for performers to prepare should be provided where applicable. • Fresh water should be readily available for the artists.
6. Liability • South Dorset Music acts as an agent and accepts no liability for any loss, damage, injury, or cancellation caused by the artist or external factors. • The Booker is responsible for insurance relating to their event, including public liability. • Artists booked through South Dorset Music are expected to carry their own public liability insurance and PAT certification if using electrical equipment.
7. Force Majeure Neither the Agency nor the Artist shall be liable for any failure to perform due to causes beyond their control, including but not limited to natural disasters, strikes, illness, pandemics, or government restrictions.
8. Conduct & Professionalism • Artists are expected to act professionally and deliver a high-quality performance. • Bookers must ensure guests do not interfere with performance or equipment. • The Agency reserves the right to remove artists from events in extreme situations that risk their safety or professional integrity.
9. Promotional Use By booking an artist, the Booker agrees that South Dorset Music may share event photos or videos (if publicly available or provided) for promotional use, unless the Booker explicitly opts out in writing.
10. Governing Law These Terms & Conditions are governed by UK law. Disputes will be resolved under the jurisdiction of English courts.
